WINE TRIP TERMS AND CONDITION

DEFINITIONS
“The Property” means the MEURSAULT property for which you make a booking.
“You”, “your” and “the Client” means any and all persons using this website or making a booking.
“We”, “us”, “our” and the Owners WINE TRIP LTD

1. Contract
Upon issue of confirmation of the booking the Contract is between the Owners and the Client. A confirmation letter will be sent on receipt of booking form and deposit as formal acceptance of the booking.

2. Booking
Provisional bookings may not be made but places can occasionally be held at our discretion by e-mail and the Client will be notified immediately if we have another enquiry for those dates. If this happens, booking forms and deposit should be sent immediately on confirmation of availability.

3. Initial Payment
A deposit of 20% of the total holiday cost is required. On receipt of the deposit, the Client will be notified immediately of receipt by the quickest method; then a written confirmation will be sent by post.

4. Balance
The balance of your holiday payment and breakage deposit is due eight weeks before the first day of your planned holiday. No reminder will be issued and in the event your payment does not reach us by the said date, we reserve the right to re-let the property concerned and in such circumstances your deposit will be refunded in accordance with condition 5.
For bookings made less than 8 weeks before the start of the rental, the total fee is payable at the time of the booking.

5. Cancellation by you
In the event of cancellation eight weeks or less before your holiday,  you become liable to pay the full amount of the total holiday cost.
Refunds of amounts paid will be made if the Owners are able to re-let the property and any expenses or losses incurred in so doing will be deducted from the refundable amount.

If you cancel the holiday more than eight weeks before your scheduled arrival date, you will lose only your initital deposit. 
The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings, public liability etc., since these are not covered by the Owners’ insurance.

6. Cancellation by us
In the event of a double booking resulting in the accommodation not being available then we will refund in full any monies paid.
In the event of cancellation by us at any time prior to the start of the holiday the deposit and any other monies paid will be refunded in full.
We will not be liable for any consequential loss you may suffer or to pay any compensation to you.

7. Arrival and Departure
• The time of arrival is Saturday 4.00 pm.
• The time of departure is Saturday 10.00 am.
There is potential to arrange more agreeable time depending on circumstances

8. Damage, Loss and Nuisance
The Client agrees to be a considerate tenant and to take all reasonable and proper care of the Property, furniture, fittings and effects in or on the Property and to leave it in a clean and tidy condition at the end of the rental period. Although a final clean is included in our prices, the Owner reserves the right to make a retention from the Breakage Deposit to cover additional cleaning costs if the Client leaves the Property in an unacceptable condition. The Client also agrees not to act in any way that would cause disturbance to those resident in neighbouring properties.

9. The Owner shall not be liable to the Client or 3rd Parties:
• for any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliance in the property, or garden.
• for any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the owner.
• for any loss, damage or inconvenience caused to or suffered by the Client if the property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owner shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.
• for any accident, loss, damage, injury, expense or inconvenience which may be suffered, arise out of or in any way connected with the rental.

10. Complaints
Any complaints, defects in the Property, breakdown in the equipment, plant, machinery or appliances at the Property should be made immediately or as soon as reasonably possible to the Owners or caretaker in order to give us a chance to rectify the situation.
In every case the complaint must be notified before departure.
It is specifically agreed by you that failure to notify a complaint immediately or as soon as possible or at all before departure will entitle the Owners to refuse to entertain the complaint, irrespective of its merits.

11. Breakages or Damage
The client is required to notify the Owners in the event of any breakages or damage caused to the property or contents. The Owners reserve the right to demand full payment for such breakages or damage.

12. Breakage deposit
A £100 breakage deposit will be taken on top of the rental fee to cover any breakage or damage caused during the rental period. In the event that there is no damage and all booking conditions have been met, this money will be returned to you within 14 days of your departure from the property.

13. Occupancy and use of property
The number of persons occupying the Property must not exceed the maximum number as shown on the website. The property shall be used for personal and domestic purposes only. The property shall not be used for any commercial purpose. Bookings will not be accepted for ‘Hen or Stag Parties’. We shall reserve the right to refuse entry to the entire party if these conditions are not observed.

14. Rules and Procedures
Clients are required to familiarise themselves with and observe the rules and procedures contained within the Information Book.

15. The Website
The Owners take every care to ensure accuracy of all property descriptions. All information is given in good faith and is correct at the time of printing/publishing on the Internet, but we cannot be held responsible for errors.

16. Smoking
The Property has a no smoking policy. For the avoidance of doubt this includes the garage area and the entire garden. If there is any evidence of smoking taking place on the property the breakage deposit will be taken to pay for a deep clean of the property.

17. Pets
Due to the possibility of some guests being allergic to pet hairs, we regret that the Owners cannot accept any pets on the Property.

18. Legal Provisions
The construction, validity and performance of the Contract between us is governed by the law of England and the parties agree to submit to the jurisdiction of the English Courts.
You agree that the Contract with the Owners is made at the Owners premises and that any proceedings between the parties shall be conducted in the County Court nearest to the Owners.

19. Right of Entry by Owners/Caretaker
The owner or agents acting under instruction from the owner shall be allowed right of entry to the property at all reasonable times on reasonable notice for the purpose of inspection or to carry out necessary repairs or maintenance.

Clause headings are for convenience only and do not form part of or affect the interpretation of these Terms and Conditions.

Important Additional Information

Guest Safety
The house has smoke detectors, fire extinguishers and fire blankets.

Inventory
The house is equipped with equipment deemed necessary for the purpose of holiday accommodation and for the maximum occupancy .

Towels and Linen
All bed linen, towels and kitchen towels are supplied, with the exception of swimming/beach towels. If you require additional bed linen and towels during your stay, please let us know and there may be an additional charge for this.

Heating/Electricity
The electricity supply is included in the rental.

Telephones
There are no phones in the house, but there is a mobile phone signal on site. We would therefore recommend that guests that wish to have phone contact take a mobile phone on their vacation.

Additional cleaning
A full clean at departure is included in the cost of your rental, if you require a mid-rental clean, we will require prior notice of this and this may incur an additional charge. The price to be agreed at the time of booking.

Out of Hours
Our caretakers Richard and Caroline (who are English speaking) are able to assist you on the telephone. Their contact details can be found in the information booklet. However, if you do require their on site assistance, please think carefully about this before you ask for this. If it is deemed that this call has been unwarranted there maybe an additional charge for this.
